Court के सामने है। एक तरफ B.C.C.I. है, जो साफ कह रहा है कि O.C.A. यानी Odisha Cricket Association को अपने elections अब कराने चाहिए। दूसरी तरफ O.C.A. है, जिसका कहना है कि National Sports Governance Act 2025 के असर को समझे बिना election process आगे बढ़ाना जल्दबाजी होगी। और इसी टकराव ने एक सामान्य administrative issue को governance, law और Indian cricket structure की बड़ी कहानी में बदल दिया है। O.C.A. elections October 2025 में होने थे... लेकिन वे दो बार postpone हो चुके हैं। B.C.C.I. का रुख कड़ा है। उसके मुताबिक अगर state association अपने constitutional obligations और Supreme Court of India से जुड़े governance principles का पालन नहीं करती, तो grants पर असर पड़ सकता है... और लंबे समय तक non-compliance रहने पर membership recognition तक खतरे में आ सकती है। B.C.C.I. की legal official Melinda Colaco ने State High Court में affidavit दाखिल करते हुए कहा कि Odisha Cricket Association के लिए election तुरंत कराना जरूरी है। मामला Court तक पहुंचा former Odisha cricketer और coach Lalitendu Bidyadhar Mohapatra की petition के बाद। Lalitendu Bidyadhar Mohapatra पहले O.C.A. election भी contest कर चुके हैं, और उनकी petition में Court से election कराने की मांग की गई है। लेकिन कहानी का दूसरा पक्ष भी उतना ही महत्वपूर्ण है। O.C.A. president Pankaj Mohanty, secretary Sanjay Behera और treasurer Bikash Pradhan October 2019 से अपने पदों पर हैं। O.C.A. ने Court को बताया कि उसके general body ने National Sports Governance Act 2025 का प्रभाव assess करने के लिए election defer करने का फैसला किया। Secretary Sanjay Behera ने यह भी कहा कि cricket अब Olympic Sport है और United States of America में होने वाले Olympic Games 2028 का हिस्सा बनने जा रहा है। इसके साथ Ministry of Youth Affairs and Sports की उस recommendation का हवाला दिया गया, जिसमें National Sports Federations के upcoming elections को December 31, 2026 तक defer करने की transitionary व्यवस्था की बात कही गई थी। लेकिन यहीं कहानी में असली legal collision सामने आता है। B.C.C.I. का कहना है कि National Sports Governance Act 2025 enacted जरूर हो चुका है, लेकिन cricket को उस Act के application के लिए designated sport के रूप में notify नहीं किया गया है। यानी O.C.A. जिस law और government recommendation को election delay का आधार बता रहा है... B.C.C.I. उसी आधार की applicability पर सवाल उठा रहा है। O.C.A. ने August 31, 2025 और February 22, 2026 को दो Special General Meetings कीं। पहली postponement का कारण December 9 को India और South Africa के बीच International T Twenty match की smooth conduct बताई गई। दूसरी postponement Ministry of Youth Affairs and Sports की recommendation से जोड़ी गई। अब Court के सामने सिर्फ election की तारीख नहीं है। बड़ा सवाल यह है कि cricket administration और association elections क्या public duty का हिस्सा हैं... या largely private administrative functions? In an affidavit before the State High Court, B.C.C.I. senior legal manager Melinda Colaco argued that an immediate election is necessary, linking the issue to the Odisha Cricket Association's own bylaws, the B.C.C.I. governance framework, and directions flowing from the Supreme Court of India. The dispute reached the Court after former Odisha cricketer and coach Lalitendu Bidyadhar Mohapatra filed a petition seeking elections to the state association. Mohapatra had previously contested an Odisha Cricket Association election, making his petition more than a distant institutional objection. It came from someone with a direct history inside Odisha cricket. Yet the Odisha Cricket Association has presented a different legal and administrative narrative. President Pankaj Mohanty, secretary Sanjay Behera, and treasurer Bikash Pradhan have held their respective positions since October 2019. The association says its general body chose to defer elections while assessing the implications of the National Sports Governance Act 2025. Its argument gains another layer from cricket's inclusion in the Olympic programme for the Olympic Games 2028 in the United States of America. Sanjay Behera also pointed to a Ministry of Youth Affairs and Sports measure recommending deferment of upcoming National Sports Federation elections until December 31, 2026, as a transitionary step. That, however, is precisely where the conflict becomes sharper. The B.C.C.I. says that although the National Sports Governance Act 2025 has been enacted, cricket has not been notified as a designated sport for the Act to apply in the manner being suggested. In other words, the two sides are not merely disagreeing about a date. They are disagreeing about which legal clock is actually running. The Odisha Cricket Association held Special General Meetings on August 31, 2025 and February 22, 2026, and resolved on both occasions to postpone the election. The first deferment was linked to preparations for the December 9 International T Twenty match between India and South Africa. The second followed the recommendation from the Ministry of Youth Affairs and Sports. From there, the dispute widened further. Through affidavits and counter-affidavits, the parties have debated whether cricket administration and the conduct of association elections amount to the discharge of a public duty. The B.C.C.I., relying on the position associated with the Supreme Court, has argued that it performs important public functions and is therefore amenable to writ jurisdiction.
